Who can apply for an open work permit?

You may be eligible for an open work permit if you:

  • are international students who graduated from a designated learning institution and are eligible for the Post-Graduation Work Permit Program
  • are a student who’s no longer able to meet the costs of your studies (destitute student)
  • have an employer-specific work permit and are being abused or at risk of being abused in relation to your job in Canada
  • applied for permanent residence in Canada
  • are a dependent family member of someone who applied for permanent residence
  • are the spouse or common-law partner of a skilled worker or international student
  • are the spouse or common-law partner of an applicant of the Atlantic Immigration Pilot Program
  • are a refugee, refugee claimant, protected person, or their family member
  • are under an unenforceable removal order
  • are a temporary resident permit holder
  • are a young worker participating in special programs

You need a Canadian Open Work Permit to work for any employer in Canada who is not listed as ineligible on the list of employers that have failed to comply with the conditions of working in Canada.

You need an open work permit to work for an employer who is not regularly offering striptease, erotic dance, escort services, or erotic massages.

Eligibility Requirements for all Applicants

Applying For Canadian Work Permit from inside Canada

You can only apply for a work permit from inside Canada if

  • you have a valid study or work permit.
  • your spouse, common-law partner, or parents have a valid study or work permit;
  • you’re eligible for a post-graduation work permit and your study permit is still valid.
  • you have a temporary resident permit that is valid for six months or more.
  • you’re waiting on a decision on an application for permanent residence from inside Canada.
  • you made a claim for refugee protection.
  • you’ve been recognized as a convention refugee or protected person by the Immigration and Refugee Board of Canada.
  • you’re allowed to work in Canada without a work permit but you need a work permit to work in a different job (this does not apply to business visitors); or
  • You’re an investor, trader, intra-company transferee, or professional in Canada.

Eligibility (Requirements) To Apply at the Port of Entry (POE)

You should apply for your work permit before you travel to Canada or when you are already in Canada.

Applying at the port of entry (POE), you must be

  • ensure you are eligible for an electronic travel authorization or to travel without a visitor visa
  • Open work permit Visa applicants (i.e you must also have a valid job offer)
  • Employer-specific work permit applicants (i.e., your employer must have completed all of the required steps for your employer-specific work permit)

Eligibility for the Seasonal Agricultural Worker Program

A seasonal agricultural worker is not eligible to apply for a work permit at a POE.

Your Documents at Port When you Travel to Canada

You need to present the following documents before you are allowed entry to Canada:

  • Port of Entry Letter of Introduction
  • your passport
